Subject: Vacation Rentals in Bayshore
Dear Property Owner:
We are contacting you regarding the property you own in Bayshore that is being used for vacation rentals. It has come to our attention by a number of concerned residents and neighbors that vacation rental homes are degrading the livability of the Bayshore community.
You agreed to abide by the C & Rs of Bayshore when you purchased your property here. This means it is your responsibility, not necessarily the rental agencys responsibility, to ensure those renting your property abide by the C & Rs.
The problems affecting the Bayshore community include:
Article II, Subsection 8a of the Guidelines for Determinations, which are based on the
C & Rs, states:
No noxious or offensive activity shall take place on any lot, nor nuisance to the neighborhood, which shall be construed as any condition or disturbance that violates the "right of quiet enjoyment" or is visually displeasing. These shall include, but are not limited to: unkempt lots, outside storage of inappropriate materials, excessive noise, barking dogs, uncontrolled dogs, abandoned vehicles, trash and debris.
Article II, Subsection 10a of the Guidelines for Determinations states:
No commercial vehicle or equipment, transport or utility trailer, inoperative vehicles with expired license plates, boats, boat trailers, RVs or similar items shall be stored on any property without prior written approval of the Planning Committee.
We ask for your cooperation in making sure your renters are not violating Bayshore
C & Rs as well as the State regulations regarding fireworks and fires on the beach. It is illegal to have any form of fireworks on the dunes or beach. Fires are not allowed in the dunes or driftwood areas of the beach per State law.
A copy of this letter is also being sent to the rental agencies renting properties in the Bayshore area. We ask that you discuss this letter with your rental agency and make sure they understand the C & Rs and State laws are not to be violated.
It is hoped we have your cooperation and no further action will be required. However, if residents of Bayshore continue to make complaints about particular rental properties, the property owner will be notified and legal action may result if problems persist. Any illegal beach activities will be reported to the Oregon Parks and Recreation Department and Oregon State Police. Other illegal road violations will be reported to the Lincoln County Sheriffs Department.
